As you know, I am a big fan of mediation for the resolution of construction disputes.  I have discussed the value, both monetarily and stress wise, of mediation on multiple occasions.  I have discussed the value of mediation even when it does not lead to settlement and had numerous Guest Post Friday posts from my good friend and uber-mediator Victoria Pynchon (@vickiepynchon), the most recent being just a couple of weeks ago.

I am such an advocate of mediation that I became a Virginia Supreme Court certified General District Court mediator, receiving my certification earlier this year.  Since then, I’ve mediated cases for the Chesterfield County, VA General District Courts and truly learned a lot and enjoyed assisting parties to come to a self-determined and likely more satisfying conclusion to their legal disputes.

I’ve enjoyed acting as a mediator so much that I’m now expanding my law practice to include the mediation of private construction disputes.  By making this move, I hope to use my years as a construction litigator and advocate to assist construction professionals to resolve their issues short of the long and expensive road to trial and judgment.  I truly believe that many, if not most, construction disputes are ripe for mediation at some stage of the dispute process (whether before filing a lawsuit or at some point between filing and judgment).

Don’t worry though, I am still committed to acting as an advocate, litigator and construction attorney to the contractors, subcontractors and other construction professionals in Virginia.

    Mediation is also a growing area of a Construction Lawyer’s practice this side of the Atlantic (Ireland) and I wholly agree with you that mediation is the best way to resolve disputes and differences in a low key, fast-track and informal manner. This is all the more so in the case of matters that arise during the course of the works.
