Recently the Associated General Contractors of Virginia published its first print magazine, Virginia’s Construction Voice. I have always enjoyed my membership in this organization and find the AGC-VA to be a worthwhile expenditure of time and resources for a construction attorney like myself.
I recommend that you check out both the organization and the magazine, and in particular please peruse the article on page 9 of the magazine where I had the pleasure to write an article entitled “University Sovereign Immunity on Construction Projects” which explores, in essence, the following:
“A clear exception to this generally accepted scheme occurs where the Commonwealth of Virginia is the owner. Virginia Code §8.01-231 specifically exempts the Commonwealth and its agencies from any general statute of limitations, including that on breach of contract actions.”
Aside from my article, the magazine has great information on workforce development, the ACA and other topics of interest to construction pros here in Virginia.
As always, I welcome your comments below. Please subscribe to keep up with this and other Construction Law Musings.
