PSA: Virginia DOLI Amends COVID Workplace Standard

As the governmental response to COVID-19 evolves, so do the various standards that apply to employers.  Effective September 8, 2021, the Virginia Department of Labor and Industry superseded its earlier permanent workplace standard with a new standard.

In many ways, the new standard simplifies compliance because it gets rid of what I believed to be overly confusing workplace classifications into risk levels and simply applies the new standard to all workplaces regardless of how they would have been classified.  Some key points to keep in mind regarding the new standard are the following (with the recommendation that all employers read and understand the text of the standard): Continue reading PSA: Virginia DOLI Amends COVID Workplace Standard

When it Comes to COVID Emergency Regulations, Have a Plan

As I hope readers of this construction corner of the “blogosphere” know, Virginia adopted emergency COVID workplace regulations effective July 27, 2020, and with enforcement beginning at the end of September.  Among the various items found in these regulations are general requirements for all employers, including among others, the requirement to self determine the employer’s risk level and disinfecting requirements.  The regulations also have some requirements that seem specially directed toward construction industry employers.  These include among them engineering controls and various requirements relating to communications with subcontractors.  For a good overview of these requirements, see this great post at the Virginia Bar Association’s construction law blog. Solo Construction Practice on Lockdown

COVID-19 or Coronavirus has affected all aspects of life here in Virginia and elsewhere.  Just about evey state has issued a stay at home order and many businesses have either been shuttered completely or have been transformed in the wake of social distancing and other measured designed to “flatten the curve.”  In Virginia, unlike some other states, construction continues to be seen as essential enough to continue while following health guidelines in this time of crisis.

Dealing With an Uncertain Construction Future in Uncertain Times

I posted previously regarding the notice issues relating to delays and COVID-19.  Here in Virginia, things got even more uncertain regarding the ability of construction companies to complete work in a timely fashion.  Ralph Northam’s latest stay at home order that adds teeth to the prior executive order closing certain businesses, limiting gatherings, etc. only muddies the construction waters further. Construction in the Time of Coronavirus

One cannot look at one’s phone, computer, or even the road outside the window without seeing signs of the impact that coronavirus (COVID-19) is having on the world at large.  Schools are shut down, traffic is lighter and there is a daily count of new confirmed cases, in Virginia and elsewhere.  “Social distancing” is the buzzword of the day.  I am writing this post from a home office because of CDC and other guidance regarding the best way to “flatten the curve.”  We have all been told to avoid large groups and stay close to home.
